The fundamental principles of modular certification remain consistent, but the specific requirements and processes can vary significantly from state to state. The Certification Process

This process typically includes design approvals, factory inspections, and site inspections to ensure that the construction meets all regulatory requirements. Beyond that, a factory must earn certification for each state where it will place homes. 

A majority of the states have additional requirements for modular factories. While some allow third parties like ICC NTA to perform factory and on-site inspections, others have their own officials perform on-site inspections while letting third parties handle the factory inspections. A third option is for states to do their own in-state factory and on-site inspections but work with third parties for out-of-state factory inspections whose product will be brought into their state.

Design Approval

The first step in the modular certification process is to approve the building design. This involves submitting detailed plans and specifications to the relevant state agency for review. The plans must demonstrate compliance with all applicable building codes and standards. During the design phase, it’s critical to consider the transportation requirements for getting the modular units to the final site. Many fail to design with the end in mind, resulting in oversized modules that require special permitting and increased costs for transportation. Factory Inspections

There are 39 states with state-specific modular programs. For the remaining states where a building will be set, the factory inspectors typically work directly with local authorities who have jurisdiction at the building site to learn what is required for the modular building to receive a certificate of occupancy. Here are a few of the states to pay particular attention to.

California

California’s modular certification is governed by the California Department of Housing and Community Development (HCD). The state has stringent regulations to ensure buildings withstand seismic activity and other environmental factors. The HCD oversees the design approval, factory inspections, and site inspections to ensure compliance with the California Building Standards Code​ (RADCO, Inc.)​.

New York

The New York State Department of State Division of Code Enforcement and Administration regulates modular construction. The state mandates thorough inspections and adherence to the New York State Uniform Fire Prevention and Building Code. Texas

In Texas, the Texas Department of Licensing and Regulation (TDLR) manages modular certification. The state’s program focuses on ensuring that modular buildings comply with the Texas Industrialized Building Code Council’s standards. Florida

Florida’s Department of Business and Professional Regulation (DBPR) oversees modular certification, emphasizing hurricane resistance and energy efficiency. North Dakota and Wisconsin

These states participate in the Interstate Industrialized Buildings Commission (IIBC), which provides a streamlined certification process that is recognized across state lines. This reciprocity helps reduce duplicative reviews and facilitates easier movement of modular units between states​ (Modular Building Institute)​.
